At Artel Agency (hereinafter "Artel," "Company," "us," or "we"), we respect and protect the privacy of visitors to our website, users interacting with our Site, and our clients who use our AI consulting, chatbot automation, and related technology services (collectively, the "Service").
This Privacy Policy ("Policy") explains how we collect, use, disclose, and safeguard your information as part of the Service. By accessing and using our Service, you indicate that you have read, understood, accept, and consent to the terms of this Policy. If you do not agree with its respect of this Policy, you should immediately discontinue access and use of our Service.
Artel Agency is incorporated in the Province of Quebec, Canada, and complies with Quebec's Act respecting the protection of personal information in the private sector (commonly referred to as "Law 25"), the Personal Information Protection and Electronic Documents Act ("PIPEDA"), and applicable data protection laws.

Personal Information We Collect
"Personal Information" means information that identifies or could be used to identify an individual directly or indirectly. We may collect the following categories of Personal Information:
a. Information from our clients
- Name, email address, phone number, and business contact details
- Billing and payment information (processed through third-party payment processors; we do not store credit card data)
- Business information relevant to providing our services (company name, industry, operational data)
b. Information from end users of our chatbots
- Chat conversation data (messages, queries, and responses exchanged with AI-powered chatbots we build and manage on behalf of our clients)
- Contact information voluntarily provided (name, email address, invoice/order tracking numbers)
- Any Personal Information voluntarily provided by end users during a chatbot conversation (e.g., name, email, order details)
c. Information collected through our website
- Usage data and analytics (pages visited, time on site, referral source)
- Cookies and similar tracking technologies (see Section 10)
- Information submitted through contact forms, newsletter sign-ups, or discovery call bookings
How We Use Personal Information
We use the Personal Information we collect for the following purposes:
- To provide, operate, and improve our chatbot and AI automation services
- To communicate with clients about their accounts, projects, and service updates
- To process payments and manage billing
- To monitor and improve the performance of AI chatbots we build for our clients (using anonymized and aggregated data only, unless explicit consent is provided)
- To respond to inquiries and provide customer support
- To send marketing communications (only with your explicit consent; you may opt out at any time)
- To comply with legal obligations and enforce our terms of service
- To analyze website usage and improve the functionality and content of our Site
AI Disclosure and Transparency
Artel builds and deploys AI-powered chatbots on behalf of its clients. In accordance with Quebec Law 25, we disclose the following:
- Our chatbots use artificial intelligence and natural language processing to generate automated responses to end user inquiries. Conversations may be processed by third-party AI platforms (see Section 7).
- End users interacting with chatbots built by Artel are interacting with AI technology, not a human agent, unless explicitly stated otherwise within the chatbot interface.
- Chatbot conversations may be recorded and stored for the purposes of service delivery, quality assurance, and performance improvement.
- If an automated decision made through our chatbot technology has a significant impact on an individual, that individual has the right to be informed of the reasons behind the decision and the right to contest the outcome by contacting the applicable client or Artel directly.
Data Sharing and Disclosure
To deliver our services, we use the following third-party service providers who may process Personal Information on our behalf:
- Voiceflow, Inc. — AI chatbot development and deployment platform. Voiceflow processes chatbot conversation data. Voiceflow is based in Canada and adheres to GDPR and applicable data protection standards.
- Webflow, Inc. — Website hosting and content management. Webflow may collect usage data and cookies through our Site.
- Stripe / Payment Processors — Payment processing for client billing. We do not store credit card information; all payment data is handled directly by the payment processor.
Analytics Providers
We may use analytics tools to understand how visitors use our Site. This data is aggregated and anonymized where possible.
We require all third-party service providers to process Personal Information in compliance with contractual restrictions, this Policy, and applicable privacy laws. No third-party service providers to use Personal Information for their own marketing purposes.

Data Retention
- Client account data: Retained for the duration of the client relationship and for a period of three (3) years thereafter for legal and accounting purposes.
- Chatbot conversation data: Retained for the duration specified in each client agreement. Default retention period is twelve (12) months unless otherwise agreed.
- Website analytics data: Retained in anonymized form; identifiable data is deleted within twelve (12) months of collection.
- Marketing data: Retained until you withdraw consent or unsubscribe.
When Personal Information is no longer required, we destroy it securely or anonymize it so that it can no longer be used to identify an individual.
Individual Rights
Under Quebec Law 25, and applicable Canadian privacy legislation, you have the following rights with respect to your Personal Information:
- Right of Access: You may request access to the Personal Information we hold about you.
- Right to Rectification: You may request that we correct any inaccurate or incomplete Personal Information.
- Right to Deletion: You may request that we delete your Personal Information, subject to legal retention requirements.
- Right to Data Portability: You may request that we provide your Personal Information in a structured, commonly used, and machine-readable format.
- Right to De-Indexation: You may request that we cease disseminating your Personal Information or that any hyperlink attached to your name providing access to such information be de-indexed.
- Right to Object to Automated Decision-Making: You may request information about and contest decisions made solely through automated processing that significantly affect you.
- Right to Withdraw Consent: Where we rely on your consent to process your Personal Information, you may withdraw your consent at any time.

Cookies and Tracking Technologies
Our Site may use cookies and similar tracking technologies. In accordance with Quebec Law 25, we obtain your explicit opt-in consent before deploying any non-essential cookies or tracking technologies.
- Essential cookies: Required for the basic functioning of the Site. These do not require consent.
- Analytics cookies: Used to understand how visitors interact with our Site. Deployed only with your explicit consent.
- Marketing cookies: Used for advertising and remarketing purposes. Deployed only with your explicit consent.

Data Security
Artel is committed to protecting your Personal Information. We implement commercially reasonable technical, physical, and administrative security measures, including encryption of data in transit (SSL/TLS), access controls, and regular security reviews.
However, no method of transmission over the Internet or electronic storage is completely secure. While we strive to protect your Personal Information, we cannot guarantee its absolute security.
Breach Notification
In the event of a confidentiality incident involving Personal Information that presents a risk of serious injury to affected individuals, Artel will:
- Notify the Commission d'accès à l'information du Québec (CAI) as soon as possible after the incident
- Notify affected individuals as soon as possible, describing the nature of the incident, the Personal Information involved, and the measures taken to reduce the risk of harm
- Maintain a register of all confidentiality incidents, which will be made available to the CAI upon request
Children's Privacy
Our services are not directed at individuals under the age of fourteen (14). We do not knowingly collect Personal Information from children under 14. In accordance with Quebec Law 25, any collection of Personal Information from a minor under 14 requires parental or tutor consent.
If we become aware that we have collected Personal Information from a child under 14 without appropriate consent, we will take steps to delete that information promptly. If you believe a child has provided us with Personal Information, please contact our Privacy Officer.
Third-Party Websites
Our Site and chatbot interfaces may contain links to third-party websites or services. This Policy applies only to information collected by Artel. We are not responsible for the privacy practices of third-party websites. We encourage you to review the privacy policies of any third-party sites you visit.
Client Warranties
Our clients represent and warrant that they have provided all necessary notices and disclosures, obtained all applicable consents and permissions, and have all authority required under applicable laws to enable Artel to provide its services, including with respect to the collection, storage, use, disclosure, and processing of Personal Information of their end users.
Business Transfers
In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of Artel's assets, Personal Information may be transferred as part of the transaction. We will notify affected individuals of any such transfer and ensure that the receiving party is bound by the terms of this Policy or an equivalent level of protection.
Complaints
If you have a complaint about how we handle your Personal Information, please contact our Privacy Officer at privacy@artelagency.com. We will investigate your complaint and respond within thirty (30) days.
